 Course Description  

Examination of the laws of arrest, probable cause, and search and seizure, including search of the person, premises, motor vehicles and emergency searches. Involves the use of necessary Federal cases, Washington State constitution (where applicable), Washington State cases, rules of criminal procedure, and the applicability of the requirements of the Fourth Amendment to the U.S. Constitution.

Learning Outcomes

After completing this course, the student will be able to:

  1. Demonstrate a working knowledge of the US Constitutional requirements for a valid arrest, search and seizure.
  2. Itemize in respect to “probable cause.”
    • Definition
    • Illustrations
    • The ingredients of probable cause
    • The basis for the methodical build-up of probable cause for the planned arrest as opposed to the immediate confrontation or emergency arrest.
    • The meaning and application of Beck v. Ohio.
  3. Relate the meaning of the Statute of Limitations to include basic application to felonies, misdemeanors and gross misdemeanors, and what is meant by tolling a statute of limitations, how one is tilled, to include the effect of running the Statute of Limitations.
  4. Describe the problems of detentions without arrest, and considerations involved.
  5. Describe the Washington State rules for officer’s power of arrest and the limited data available in the State of Washington on the citizen’s power of arrest.
  6. Specify the application of Mapp v Ohio to searches and seizures in terms of what does it mean, specifically the application of the exclusionary rule to searches and seizures, and what is the “Exclusionary Rule.”
  7. Itemize the basic authorities an officer has to search; first generally, and then as to persons, premises and finally motor vehicles. In so doing, the student will demonstrate a knowledge of three cases in the regard, specifically Vale, Chimel and the Carroll case.
  8. Relate the applicable rules (and source) for obtaining a search warrant, when must it be executed, when returned, and on what basis must a search warrant be founded.
